Pandemic-related workplace operations and changes in the social landscape have led to a dramatic increase in the volume and severity of employment practices liability insurance (EPL) claims. Runaway jury verdicts against policyholders are increasingly common and having coverage counsel with EPL expertise is more important than ever.

Our team has significant experience representing insurers in a wide variety of EPL related risks, including underlying claims involving discrimination, workplace harassment, retaliation, whistle-blower activity, reductions-in-force, and violations of wage and hour laws. We work closely with policyholders to evaluate the merits of these claims and to frame them for mutually acceptable settlements, usually through mediation. Because many of these claims carry the risk of runaway jury verdicts, we are especially mindful of considering the rights and obligations of our insurer clients on a jurisdiction-by-jurisdiction basis.
