Alan Joaquin

Alan Joaquin represents insurers in coverage litigation relating to directors and officers liability insurance; errors and omissions coverage; cyber, privacy, and media liability; and fidelity bonds. He has defended insurers’ interests in both federal and state courts as well as in arbitration proceedings. Frequently, Alan is also retained to defend his client’s insureds in matters involving cyber breach disputes and privacy actions.

Alan previously served with the Fraud Section of the U.S. Department of Justice’s Criminal Division, focusing on financial institutions, pharmaceutical companies, and durable medical equipment providers. While at the DOJ, Alan worked with the Department of Health and Human Services in matters involving the Medicare/Medicaid Anti-Kickback Statute and its corresponding safe harbor regulations.

  • Defended insurers in connection with cyber extortion claims including those arising from NotPetya malware.
  • Defended insurers in connection with cyber breach claims.
  • Investigated and resolved computer network interruption claims involving extensive business interruption coverage.
  • Represented cyber and media insurers in connection with class actions claims brought under the Michigan Video Rental Protection Act.
  • Represented insurers in connection with class action claims brought under the Illinois Biometric Information Privacy Act.
  • Defended insurers in connection with copyright and trademark litigation claims brought under media liability insurance policies.
  • Defended corporate crime insurers in connection with a $1.3 billion Ponzi scheme.
  • Defended a developer’s interests in connection with a governmental investigation brought by the Consumer Protection Section of the DC Attorney General’s Office.
